What is an Award?
An Award is an Industrial instrument that stipulates the conditions of a workplace (e.g. Hours of work, allowances, penalties, pay rates, and job classifications). Other Industrial Instruments can be a Collective Agreement or Enterprise Agreement.
Fair Work Australia now has jurisdiction over Industrial Relations in most States with exception of Western Australia.
From 1st of January 2010, employers who are a Constitutional Corporation (Pty Ltd) now have a Modern Award for their industry that will apply nationally.
Sole Traders and Partnership are also covered by the Modern Award from 1st January 2011.
Previous awards such as NAPSA’s and State Awards no longer apply.
